Tualatin Development Code Update Effective January 10, 2019

The Tualatin Development Code (TDC) was updated by Ordinance No. 1414-18 and is effective January 10, 2019. The revisions modify Chapters 31-80 of the TDC, and make minor changes to Chapters 1 and 2 of the Community Plan. The code amendments:

  • Reorganized Chapters and Sections into a consistent structure and logical sequence;
  • Streamlined Planning District/Zoning Chapters through the use of tables and standardized Use Categories;
  • Created new TDC Chapters to simplify, clarify, and consolidate information previously scattered throughout multiple sections of the code; and
  • Clarified language,  corrected errors, and updated the code to comply with current legal requirements.

What is the purpose of requesting the person who most recently had a birthday complete the survey?

We hae randomly selected households within our jurisdiction to receive the survey. We would also like to choose in an unbiased way a person within each household to complete the survey. This way we ensure the results are representative of our community as a whole. While it may seem a bit strange, using the "birthday method" is a simple way to select an adult from within each household without permitting bias in our results.

What Type of Study is Required?

There are two levels of additional analysis that may be required:

  1. A Trip Generation and Distribution Description describes the amount of traffic (including all modes of travel) that would be anticipated going to and from the proposed development, and the common routes this traffic would use.
  2. A Transportation Impact Analysis is a more detailed study of the existing and future transportation network (for all modes of travel) and how the proposed development would affect the transportation network.  The first phase of competing a Transportation Impact Analysis is completing a Trip Generation and Distribution Description

What will be done with the results?

The results will be presented to the City Council in July or August 2020 and also made available to the public. The results will be used to help shape priorities and projects over the next few years.

What’s happening with scheduled City events?

To help limit the spread of the COVID-19 virus and protect our community members’ health, all regularly scheduled City programs and events are cancelled through May 31, and some major events beyond that date. 

However, City staff in our Library, Parks & Recreation Department, and Juanita Pohl Center have been working hard to provide many ways to keep our residents busy and active from the safety of their homes. The Library is offering free online programs such as online story-time and book chats, poem readings, and more, and you can access their many digital services with your WCCLS library card.

The Parks & Recreation Department has been busy providing many excellent and exciting online resources for free kids programs, yoga classes, virtual tours, game ideas, scavenger hunts and projects. The Juanita Pohl Center is offering online virtual fitness classes and other resources for our older adults.

Where do I report a business that is not complying with the Governor’s Executive Order?

Who can I call if I see people congregating?

Tualatin officers will respond to reported complaints of non-compliance through the non-emergency dispatch line, 503-629-0111. Please DO NOT call 911, which is reserved for police, fire, and medical emergencies.

Why did the City Council adopt new regulations?

Two recent decisions out of the Ninth Circuit Court of Appeals (Martin v. Boise and Johnson v. City of Grants Pass) held that a governmental entity cannot “criminalize conduct that is an unavoidable consequence of being homeless – namely sitting, lying, or sleeping” under the Eighth Amendment to the Constitution. In addition, individuals similarly must be permitted to take minimal measures to keep warm and dry while sleeping.

In 2021, the Oregon Legislature passed HB 3115 (codified as ORS 195.530), which requires any regulation of sitting, lying, sleeping, or keeping warm and dry outdoors on public property that is open to the public to be objectively reasonable as to time, place, and manner prior to July 1, 2023.

Previously, camping was not allowed in the City of Tualatin. The Tualatin City Council adopted new regulations to be compliant with the new state and federal laws.

Why is "Hispanic" separate from "Race"?

We want to compare the demographic profile of those responding to the demographic profile of the municipality as presented by the Census. In order to be able to do this we asked our race and ethnicity question the same way the Census does.

Will Bulky Waste Day still take place as planned?

Bulky Waste Day scheduled for May 2, 2020 has been canceled and will be rescheduled for a future date.  

Additionally, Republic Services is not collecting bulky waste curbside at this time.

Will I start seeing huge camps in Tualatin?

The draft ordinance includes place regulations that prohibit camping on most public property, including City parks, sidewalks, along the river, and on trails throughout the City. The draft ordinance limits outdoor camping on public property to one lot on SW Tualatin Rd adjacent to the Police Department. 

The ordinance restricts the size of campsites to 12 ft x 12 ft and requires a 10 ft buffer between campsites.

Will my trash, recycling, and yard debris be picked up? Do I need to do anything differently?

Yes, Republic Services will continue to collect waste from households and businesses on regular schedules. 

Federal health and safety agencies have determined that household waste does not require special handling or separation. However, to minimize drivers getting out of the curb and handling material, please make an effort to keep all waste inside of your roll carts. Any extra material left outside of the carts must be sealed tightly in a bag.

There is a new park fee on my utility bill, why?

In April 2021, City Council approved a Parks Utility Fee to fund the management and maintenance of your City parks. Just as the water and sewer utility fee pays for the maintenance and upkeep of your water and sewer system; the parks fee will cover renovations, replacements, and sustainable repairs of your City parks.
